Middlefield Glass Inc. and http://www.quickshipglass.com are a single entity and thus all Terms for Middlefield Glass Inc. apply to http://www.quickshipglass.com.

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site.

By accessing or using the Site you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Site.

General

If you breach these Terms and Conditions and we take no action, or if we delay in acting, that does not mean that we have waived our rights and we will still be entitled to exercise and enforce our rights and remedies. If we do act against you for any reason, we will only do so in writing (signed by a director of Middlefield Glass Inc.), which does not mean that we automatically waive any other or subsequent breach by you.

Each of the sections and paragraphs of these Terms operates separately. If any provision of these Terms is found to be unlawful or unenforceable, all other provisions shall remain in full force and effect.

These Terms may not be varied except with our express written consent.

These Terms shall be governed by Ohio law, and all disputes or claims arising out of or in connection with these Terms or its subject matter or formation (including non-Contractual disputes or claims) will be governed by Ohio law.

Our Product(s) available from the Website will be supplied by Middlefield Glass Inc. from its available stock.  Unless otherwise you are otherwise notified, Middlefield Glass Inc. will be responsible for supplying the Product(s) purchased by you on the Website. When you purchase our Product(s) on the Website you will enter a Contract (“Contract”) of sale between you and Middlefield Glass Inc. which is governed by these Terms.

No Liability

SUBJECT TO APPLICABLE LAW, INCLUDING WITH RESPECT FOR PERSONAL INJURY OR NON-WAIVABLE STATUTORY RIGHTS UNDER OHIO LAW. IN NO EVENT SHALL MIDDLEFIELD GLASS INC. OR ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS (A) BE LIABLE TO THE USER WITH RESPECT TO USE OF THE SITE. THE CONTENT OR MATERIALS CONTAINED IN OR ACCESSED THROUGH THE SITES (INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY A USER ON ANY INFORMATION OBTAINED FROM MIDDLEFIELD GLASS INC.), OR ANY DAMAGES THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF DIVINE POWER, COMMUNICATIONS FAILURES OR ERRORS, THEFT, DESTRUCTION, FRAUD, OR UNAUTHORIZED ACCESS TO MIDDLEFIELD GLASS INC.’S RECORDS, PROGRAMS OR SERVICES; AND (B) BE LIABLE TO THE USER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF USER INFORMATION, OR THE INABILITY TO USE THE SITE. THE USER’S SOLE REMEDY IS TO CEASE USE OF THE SITE.

Product Information

Most Middlefield Glass Inc. products displayed at the Site are available in the Middlefield Glass Inc. store while supplies last. In some cases, merchandise displayed for sale at the Site may not be available at Middlefield Glass Inc. store. The prices displayed at the Site are quoted in U.S. Dollars and are valid and effective only in the United States.

Risk and Ownership

Once the Middlefield Glass Inc. product(s) ordered have been delivered or collected (as the case may be) you are responsible for them. Ownership of our Product(s) will pass to you on delivery or collection (as the case may be), provided full payment, have been received. This means that any damage to our Product(s) arising after delivery or collection will be you will be responsible for. Additionally, any damage that occurs after the product is dispatched from Middlefield Glass Inc. is no longer our responsibility. Our mail and package currier will be responsible for any damaged or lost goods. Middlefield Glass Inc. cannot be held accountable for our Product(s) that are damaged after it leaves our facility.

Price and Purchases

The price of our Product(s) is as quoted on the Site from time to time.

Prices include VAT but exclude delivery costs, which will be automatically added to our Product(s) price when you view the items in your cart and have selected your chosen delivery method.

If you wish to purchase any product or service made available through the Site, you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, billing address, shipping address, payment information (including credit card numbers, gift cards, and company credit), email address, contents of your online cart, and phone number.

Prices and delivery costs are liable to change at any time, but changes will not affect orders that have already shipped.

The Site contains Middlefield Glass Inc. Product(s) and it is always possible that, despite our best efforts, some of our Product(s) listed on the Site may be incorrectly priced or not available for purchase. We will normally verify prices and availability as part of our dispatch procedure so that, where the correct price is less than our stated price, we will charge you the lower amount. If our Product’s correct price is higher than the price stated on the Site, we will either contact you for instructions before dispatching our Product or reject your order. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may cancel the order, refund you any sums you have paid, and require the return of any Middlefield Glass Inc. Product(s) delivered to you.

Payment for all orders must be made by credit or debit card on the checkout page. We accept payment by most major credit and debit cards, including Visa, MasterCard, Discover.

You should be aware that online payment transactions are subject to validation checks by your card issuer. We are not responsible if your card issuer declines to authorize payment for any reason. We carry out a standard pre-authorization check on your payment card at the time you place an order, and our Product(s) will not be shipped until payment for the entire costs of the order has been authorized. We are not responsible for any reimbursement or credit if your card issuer may charge you an online handling fee or processing fee.

Returns Policy

MIDDLEFIELD GLASS INC. WILL NOT ACCEPT RETURNS UNDER ANY CIRCUMSTANCES, OR REFUND GLASS PER YOUR REQUEST.

Delivery

Our logistics provider will aim to deliver your order by the delivery date unless there are exceptional circumstances. If, for any reason, we cannot make your delivery within 30 days, you can contact us to discuss your options.

Your order will be delivered to the delivery address you specified when placing your order. Depending on your location and the delivery address.

If your delivery address is geographically remote, for example certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you. We reserve the right not to deliver to any country that is prohibited by applicable laws.

Middlefield Glass Inc. products comprised within the same order cannot be split and delivered to different addresses.

Deliveries are made by couriers and take place on Monday, excluding bank and public holidays, usually between 8:00 am and 6:00 pm. Saturday deliveries may be available in some locations. It is not possible to specify a precise time at which a delivery will take place, and delivery time might vary depending on geographic location of your delivery address and the courier used. Please note that the courier might require deliveries to be signed for.

You may be required to pay import duties and taxes on international deliveries. Middlefield Glass Inc. has no control over these charges and cannot predict the amount. We recommend that you contact your local customs office for further information before placing an order.

If no one is available at the delivery address to take delivery the courier will leave a note about what to do to collect the package or re-arrange delivery. If you do not collect or re-arrange delivery, we hold the right to charge you for additional storage or re-delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end we will cancel your order without refunding your purchase.

Please note that you must comply with all applicable laws and regulations of the state for which Middlefield Glass Inc. products are destined. We will not be liable for any breach by you of any such laws.

IT IS REQUIRED THAT YOU INSPECT THE PRODUCT WITHIN 24 HOURS OF DELIEVERY, NO EXCEPTIONS.

If the packaging or contents are broken in any way, send us comprehensive photos to info@middlefieldglass.com within 24 hours of delivery. Inspect the glass before removing the plastic wrapping or removing the sharpie line. If the glass is broken, leave it in the wrapping and send pictures. After photos are sent, our postal service providers will process the claim. UPS will determine if the order is full refunded or not and we will notify you. Then Middlefield Glass Inc. will proceed in replacing the order no charge if it is determined it broke in transportation to your doorstep. If the Damage Claim determines that it did not break in transport, the order will not be refunded to you, and we will be unable to provide a complimentary replacement.

Intellectual Property, Software and Content

Middlefield Glass Inc. owns or has permission to use the intellectual property rights on its Site and its content. These rights are protected around the world. All such rights are reserved.

You’re allowed to store, print and display our Website content only for your own personal use. You are not allowed to use any part of the Site for commercial purposes unless you have our express permission.

You’re also not allowed to use the Middlefield Glass Inc. logo or any Middlefield Glass Inc. brand or trademark (or any marks which are similar) without our express permission.

Sourcing Policy

We are committed to offering our customers high quality products, we strive to ensure that our suppliers are operating ethically. Middlefield Glass Inc. expects all suppliers to consistently provide an environment which protects their employees’ health and safety and basic human rights. All suppliers are expected to comply with national employment laws and regulations with particular regard to: minimum age of employment, freely chosen employment, health and safety, freedom of association and the right to collective bargaining, no discrimination, no harsh or inhumane treatment, working hours, rates of pay and terms of employment.

We never knowingly allow sourcing from countries which are in breach of these principles.

Middlefield Glass Inc. looks to its suppliers to instill these principles when dealing with their own supplier base and supply chain.

It is not always possible to monitor and control the conditions of everyone involved in the production of Middlefield Glass Inc. Product(s).
